GLOBAL PRIVACY POLICY

1.⁠ ⁠LEGAL AGREEMENT These Terms and Conditions ("Terms") constitute a legally binding agreement between HEXORA GROUP LLC ("the Company", "We") and you ("Client", "User"). By accessing our software development services, AI integrations, or proprietary platforms, you agree to these Terms. If you are under 18 or do not agree, you must cease all use immediately.

2.⁠ ⁠SCOPE OF SERVICES HEXORA GROUP LLC provides:

  • Custom Software & AI Development: Governed by independent Statements of Work (SOW).
  • Digital Platforms: Video chat, streaming, and gaming applications.
  • Virtual Assets: "Credits" or digital licenses for internal use within our ecosystem.

3.⁠ ⁠PAYMENT, REFUND, AND ANTI-FRAUD POLICY

  • 3.1. General Terms: HEXORA GROUP LLC utilizes third-party payment processors (Stripe, Adyen, Paypal etc). You authorize HEXORA GROUP LLC to charge your method of payment for the agreed amounts.
  • 3.2. Final Sale Policy: For software milestones or digital credits, ALL SALES ARE FINAL. Pursuant to international consumer law, you expressly consent that the supply of digital content begins immediately upon purchase, and you waive your right of withdrawal or refund once the credit is added to your account or the service is initiated.
  • 3.3. Evidence of Delivery: The appearance of the credit balance in the User’s account or the delivery of code via repository constitutes irrefutable evidence of delivery by HEXORA GROUP LLC.
  • 3.4. Mandatory Dispute Resolution: Before initiating a chargeback, the User must contact HEXORA GROUP LLC at legal@hexoracorp.com to attempt a 15-day good-faith resolution.
  • 3.5. Chargeback Consequences: Fraudulent chargebacks shall result in account termination. HEXORA GROUP LLC reserves the right to recover the disputed amount plus a $50.00 USD administrative fee and any legal costs incurred.

4.⁠ ⁠AI TRANSPARENCY AND LIABILITY (EU AI ACT 2026)

  • Disclosure: Users are notified when interacting with AI systems.
  • Algorithmic Limitation: HEXORA GROUP LLC is not liable for "hallucinations" or errors from third-party AI models (OpenAI, Anthropic, etc.). The Client assumes all risk for the commercial use of AI outputs.
  • Non-Training Guarantee: HEXORA GROUP LLC does not use Client-proprietary data to train global third-party models without explicit written consent.

5.⁠ ⁠INTELLECTUAL PROPERTY

HEXORA GROUP LLC transfers ownership of human-authored code upon full payment. AI-generated components are provided under a perpetual license. Users are prohibited from using HEXORA GROUP LLC technology to generate adult content, weapons-related material, terrorims, discrimination or hate speech.

6.⁠ ⁠LIMITATION OF LIABILITY

To the maximum extent permitted by Wyoming law, the total liability of HEXORA GROUP LLC shall not exceed the amount paid by the Client in the six (6) months preceding the claim. HEXORA GROUP LLC is not liable for API failures of third-party providers.

7.⁠ ⁠GOVERNING LAW AND ARBITRATION

These Terms are governed by the laws of the State of Wyoming, USA. Any dispute shall be settled by Binding International Commercial Arbitration (AAA Rules). Both parties waive their right to participate in class-action lawsuits.

1.⁠ ⁠DATA COLLECTION AND MINIMIZATION HEXORA GROUP LLC collects identification data (name, email), transactional data (via Stripe), and technical logs. We do NOT process sensitive data (biometrics, health, financial, religious etc.).

2.⁠ ⁠LEGAL BASIS AND TRANSFERS Processing is based on contractual necessity and legal obligations. Data is hosted on Google Cloud (USA). For international users, HEXORA GROUP LLC utilizes Standard Contractual Clauses (SCCs) to ensure GDPR/LGPD compliance.

3.⁠ ⁠DATA RETENTION Financial/Legal Records: 5 years (Wyoming Statute of Limitations).

  • Technical Logs: 12 months
  • AI Inputs: Deleted/anonymized upon task completion unless otherwise agreed.

4.⁠ ⁠SECURITY AND BREACHES

HEXORA GROUP LLC uses AES-256 encryption. We will notify authorities and affected users within 72 hours of any confirmed data breach.

5.⁠ ⁠YOUR RIGHTS

Users may request access, rectification, or deletion of their data by contacting the Privacy Officer of HEXORA GROUP LLC at legal@hexoracorp.com

I declare under my responsibility that I have full legal capacity and ability to contract. I have read, understood, and freely, autonomously, and unequivocally accept the Terms and Conditions and Privacy Policy of HEXORA GROUP LLC.

CRITICAL UNDERSTANDING: I am aware that by completing this payment, the immediate execution of digital services and/or delivery of virtual assets begins. Therefore, I expressly waive my right to withdrawal, recission, or refund once the transaction is processed, in accordance with the exceptions for on-demand digital content. By checking this box and clicking 'Pay,' I formally enter into a binding contract.
